We review with our clients their personal and financial information, access the tax implications and consequences of planning decisions and implement planning techniques designed to minimize taxes while maximizing distributions to heirs.
A Guardianship is a legal relationship established by the New Jersey Probate Court giving one person (the Guardian) the power to make personal and financial decisions for another (the Ward). Guardians are appointed when the Court determines that individuals are unable to care for themselves and/or their assets because of mental illness, mental retardation or physical incapacity. We are experienced is assisting individuals seeking to be appointed as guardian for a loved one.
We represent individuals in administering the estate of a loved one. Representation starts with probating the last will & testament with the Surrogate, continues through drafting and filing the necessary surrogate court papers, preparing or reviewing the appropriate tax returns and concludes with the distribution of the estate assets.
While government benefit programs such as SSI and Medicaid offer substantial health care coverage, the available cash benefits are minimal. A well drafted Special Needs Trust preserves the disabled person's eligibility to receive governmental benefits while providing additional funds to add to the quality of his or her life. We can assist families of the disabled in planning their estates and/or structuring monetary judgments or settlements so as not to jeopardize eligibility to receive government benefits.
Nursing home negligence occurs when a nursing home or other senior facility fails to provide care in a reasonable manner and as a result a resident is physically or emotionally abused or neglected. Nursing home negligence can result in death, falls causing broken bones, malnutrition, dehydration and bed sores. When the circumstances dictate, we represent clients before the courts during litigation, including will challenges and fiduciary accountings.
We accept appointments as Guardian, Conservator, Administrator or Trustee and assume all decision making responsibility for an elderly or disabled person, including decisions regarding medical treatment, living arrangements, and management of assets.
